Terms of Service

These Terms govern use of Malatrading's website, account services, marketplace features, and orders. Please read them before using the service or placing an order.

Contracting party and contact. In these Terms, “Malatrading”, “we”, “us”, and “our” mean the Malaysia-registered business operating this service. Questions, notices, and complaints may be sent to support@malatrading.com.

1. Acceptance, eligibility, and scope

By accessing or using the service, creating an account, or submitting an order, you agree to these Terms and to the Privacy Policy, Shipping Policy, Returns Policy, Payment Policy, and Cancellation & Refund Policy. You must be legally capable of entering into a binding agreement in your location, provide accurate information, and use the service only for lawful personal or business purposes. If you use the service for an organisation, you confirm that you are authorised to bind that organisation.

2. Marketplace role and product information

Malatrading may offer goods directly and may operate a marketplace that connects customers with independent suppliers. Where a product is supplied by a marketplace supplier, that supplier may be responsible for product information, availability, fulfilment, warranties, and statutory obligations identified in the listing or at checkout. Product images, descriptions, specifications, compatibility information, prices, promotions, ratings, availability, and delivery estimates are provided for convenience and may be corrected or updated before an order is accepted. Nothing on the service is a guarantee that a product will be available, suitable for a particular purpose, or delivered by a particular date except where we expressly agree otherwise in writing.

3. Orders and formation of contract

  • Submitting an order is an offer to purchase the selected goods under the terms displayed at checkout.
  • An automated acknowledgement confirms receipt only. A contract is formed only when we or the relevant supplier expressly accepts the order, dispatches the goods, or otherwise confirms acceptance.
  • We may refuse, limit, cancel, or require verification for an order where there is a pricing or listing error, suspected fraud, payment failure, stock or delivery limitation, legal restriction, breach of these Terms, or other reasonable operational reason.
  • You are responsible for ensuring that your order, contact information, delivery address, and any import or product restrictions are accurate before submitting an order.

4. Prices, payment, taxes, and customs

Prices, currency, discounts, delivery charges, and any tax or duty information shown at checkout apply to the relevant order unless an obvious error has occurred. Payment is governed by our Payment Policy. For cross-border orders, customs duties, import taxes, clearance charges, product approvals, or other destination-country requirements may apply. Unless we expressly state at checkout that they are included, these charges and obligations are the recipient's responsibility. Your payment provider may charge currency-conversion or transaction fees that are outside our control.

5. Delivery, risk, cancellations, returns, and refunds

Delivery arrangements are governed by our Shipping Policy. Delivery times are estimates unless we expressly guarantee a date. You must cooperate with reasonable delivery, identification, customs, and collection requests. Cancellation, return, and refund requests are governed by the linked policy pages and applicable mandatory consumer law. Nothing in these Terms limits rights that cannot lawfully be excluded or restricted.

6. Accounts, security, and acceptable use

  • Keep account credentials confidential and notify us promptly of unauthorised use. You are responsible for activity carried out through your account unless applicable law provides otherwise.
  • Do not create accounts with false information, interfere with the service, bypass technical controls, scrape or harvest data, use automated means without permission, manipulate reviews or promotions, submit fraudulent orders, or infringe another party's rights.
  • We may suspend or close an account, cancel an order, remove content, or restrict access where reasonably necessary to protect users, suppliers, the service, or legal compliance.

7. Intellectual property and third-party services

The service, branding, software, text, graphics, and other content owned or licensed by Malatrading are protected by applicable intellectual-property laws. We grant you a limited, revocable, non-transferable right to use the service for its intended purpose. You may not reproduce, modify, distribute, reverse engineer, or commercially exploit service content without prior written permission. Third-party products, payment services, carrier services, links, and supplier materials may be subject to separate terms, and we are not responsible for third-party services except as required by law.

8. Disclaimers and limitation of liability

To the maximum extent permitted by law, the service and non-mandatory content are provided on an “as available” basis. We do not exclude liability for fraud, death or personal injury caused by negligence where such exclusion is unlawful, or any other liability that cannot lawfully be excluded. Subject to that limitation, Malatrading is not liable for indirect, incidental, special, punitive, or consequential loss, loss of profits, data, goodwill, or business opportunity arising from use of the service. Our total liability for a claim relating to an order will not exceed the amount paid by you for the affected order, except where applicable law requires otherwise.

9. Changes, governing law, and complaints

We may update these Terms for legal, security, operational, or service reasons. Updated Terms apply from the stated effective date; material changes will be notified where required by law. These Terms are governed by the laws of Malaysia, without prejudice to mandatory consumer protections that apply in your place of residence. Before bringing a claim, please contact support@malatrading.com so we can try to resolve the issue. Courts with mandatory jurisdiction under applicable law may hear any dispute.
